Kolkata. murder case: The Supreme Court has granted interim bail to 104-year-old Rasik Chandra Mandal in a murder case. A bench headed by Chief Justice Sanjiv Khanna gave this decision. Mandal, who was convicted in a murder case in 1988, will now be granted temporary release on the terms of the trial court after being granted bail by the Supreme Court.
Rasikchandra Mandal was convicted of murder in 1994. In this case he was sentenced to life imprisonment. After this, he approached the court several times challenging his sentence. After this, now the Supreme Court has given relief to Mandal.
1920 Rasik Chandra Mandal was born in an unknown village in Malda district of West Bengal. In the same year the Indian National Congress started the non-cooperation movement against the British. Mandal was 68 when he was convicted in 1994 of one of the 1988 murders and sentenced to life imprisonment. Due to illness, he was transferred from jail to a reform home in Balurghat, West Bengal. In 2018, the Calcutta High Court and then the Supreme Court rejected his appeal against the sentence.
Mandal again filed a writ petition in the Supreme Court (murder case) in 2022, when there was one year left to cross the hundred mark. He had demanded early release citing increasing age and related diseases. It also sought exemption from the requirement to spend 14 years in prison to be eligible for parole or remission of sentence. In this matter, the bench of now retired Justice A Abdul Nazeer and Justice Sanjiv Khanna issued notice to the West Bengal government on 7 May 2021. In this court notice, the superintendent of the correctional facility was asked to submit a report on the health of Mandal, who has been in jail since January 14, 2019.
The matter came up for hearing on Friday before a bench of Chief Justice Sanjiv Khanna and Justice Sanjay Kumar. He asked lawyer Aastha Sharma, representing the West Bengal government, about Mandal's position. Sharma told the Supreme Court that Mandus had age-related health problems. But otherwise he is stable and will soon celebrate his 104th birthday. After this, the Chief Justice's bench accepted Mandal's petition. Also, Mandal was ordered released on interim bail in a case registered on November 9, 1988, at Manikchak police station in Malda district.
