Big decision of Subhendu government of Bengal, gave free hand to CBI for investigation
The West Bengal government has taken an important decision regarding the Central Bureau of Investigation (CBI). Under the new notification issued by the State Home and Hill Affairs Department, CBI has been allowed to investigate some special category cases. After this decision, widespread discussion has started in political and administrative circles.
Although it is being claimed at many places that the state government has given free hand to CBI to investigate all the cases, but after studying the notification, the picture appears different. The government has given permission for investigation only within limited scope.
Under which law was the permission given?
This permission has been given under Section 6 of the Delhi Special Police Establishment (DSPE) Act, 1946. Under this law, CBI obtains the consent of the state governments to conduct investigations in different states. The new notification will be considered effective from June 8, 2026. After this, CBI will not need to take separate permission in some cases.
In which cases will CBI be able to investigate?
Under the new system, CBI has been given the authority to investigate cases related to the central government. This mainly includes matters related to central government employees. Apart from this, the agency will also be able to investigate cases related to officers and employees working in Central Public Undertakings (PSU). If a private person is accused of committing a crime in collaboration with a central employee or an employee of a central undertaking, then CBI can also investigate such cases by taking them under its jurisdiction.
This can make the investigation process of corruption, financial irregularities or other crimes related to central government departments and undertakings easier.
In which cases will state approval still be required?
The most important aspect of the new notification is that CBI has not got the right to investigate on its own in cases related to state government employees. If in any case the departments, agencies or state employees under the control of the Government of West Bengal have to be investigated, the CBI will first have to obtain separate written permission from the State Government. Without permission, the agency will not be able to take direct action in such cases. That is, the state government has retained control over matters related to its administrative system.
How correct is the notion of ‘complete exemption’?
After the notification, it was believed that West Bengal has given complete freedom to the CBI, but from the legal point of view this conclusion cannot be considered correct. The government has restored general consent only for the Central Government, Central Undertakings and matters related to them. In matters related to state administration, the permission system will continue to be applicable as before.
Administrative and political importance
Experts believe that this decision reflects a balanced approach between the Center and the State regarding the jurisdiction of the investigating agencies. On one hand, the path of investigation has been made easier in matters related to central institutions, while on the other hand, the state government has maintained constitutional control over matters related to its officials. In the coming times, everyone will be watching how this decision will affect the coordination between central and state agencies.
