The Supreme Court said, “The courts have always recognized that fights and differences in domestic life are common in the society. The outcome of such a crime largely depends on the mental condition of the victim.”
The Supreme Court said in a decision on Friday that breaking the promise of marriage or breakup cannot be considered as incitement to suicide. However, when such promises are broken, one may become emotionally upset. If he commits suicide due to emotional distress then no one else can be held responsible.
Saying this, the Supreme Court bench of Justice Pankaj Mithal and Justice Ujjwal Bhuiyan overturned the decision of the Karnataka High Court. The Karnataka High Court convicted accused Kamaruddin Dastagir Sanadi of cheating on his girlfriend and driving her to commit suicide.
