face , Gujarat’s Surat district court on Thursday convicted Congress MP Rahul Gandhi in connection with his ‘Modi surname’ remark in April 2019. Gandhi was convicted under sections 499 and 500 of the IPC. The maximum punishment under this is two years. The court of Chief Judicial Magistrate HH Verma found him guilty and sentenced him to two years in jail and also imposed a fine of Rs 15,000. However, the court suspended the sentence and granted bail to appeal within 30 days.

Rahul Gandhi’s lawyer said that he will go to the sessions court soon.

Chief Judicial Magistrate HH Verma last week fixed March 23 for pronouncement of the verdict after hearing arguments from both the sides. Gandhi has said that when he made the said statement, there was no malice on his part.

Congress MP Rahul Gandhi, after his conviction by a Surat court, may face disqualification as an MP and will not be able to contest elections if his sentence is not suspended by the higher courts. Under the Representation of the People Act, 1951, if a person is sentenced to imprisonment for two years or more, that person is disqualified for a term of imprisonment and a term of six years.

But, there is an exception in the Act for existing members. He has been given a period of three months from the date of conviction to appeal and the disqualification will not apply until the appeal is decided.

Significantly, on Thursday, a district court in Surat in Gujarat held Congress MP Rahul Gandhi guilty of defamation over his ‘Modi surname’ remark in 2019.
