Prayagraj. A single bench of Justice Arvind Kumar Mishra has given this decision on Friday on the petitions filed by Lord Krishna Virajman and seven others. In this, a demand was made to hear the matter in the High Court.

The bench accepted the transfer applications filed by Shri Krishna Virajman Mandir Katra Keshav Dev, Khevat Mathura and seven others to transfer all the cases. There was a demand in the petition that like the Ram temple case in Ayodhya, this case should also be heard in the High Court.
The High Court had reserved the decision on May 3 after hearing the arguments of all the parties. Justice Mishra has also requested to nominate a suitable bench for hearing while sending the matter to the Chief Justice.

The court has said in the order that the right of worship in Shri Krishna Janmabhoomi Mathura, which was once the prison of Maharaja Kansa, and the matter of removal of the mosque built on it, is related to the feelings, faith and belief of crores of Hindus and Muslims of both the religions. In this, the laws and articles of the constitution have to be explained.
There is a distinction to be made between Waqf and Trust. Citing the Shri Ram Janmabhoomi dispute case, the court has said that the trial of the case in the subordinate court will be delayed. In the interest of justice and to save the time of litigants, the issue of Shri Krishna Janmabhoomi site should be resolved in the High Court like Ram Janmabhoomi.
The court also said that Lord Krishna appeared in human form in the prison. It is believed that a mosque has been built on the jail. It is also a matter of rights and history. It has to be decided whether the Places of Worship Act 1991 will be applicable on this. Articles 25, 26, and 300A of the Constitution, many questions like service, birthplace will have to be answered. No one’s rights will be affected if all the cases are heard together in the High Court.
Senior advocate Vishnu Jain, representing the Hindu side, said that at the time of filing the petition in the Mathura court regarding the 13.37-acre land dispute between Shri Krishna Janmabhoomi and Shahi Idgah Masjid, 10 cases were pending. Now some more new cases have been filed. All cases related to land disputes should be heard simultaneously in the High Court. The Muslim side said that the land was auctioned by the British and some part was given to build a mosque.
