The Special Court acquitted the accused on the basis of the statement and available evidence. The state government challenged this decision in the High Court, but Justice Sanjay S. The division bench of Justice Aggarwal and Justice Radhakishan Aggarwal rejected the appeal.
The bench said that the age of the victim could not be proved to be less than 18 years. The father could not provide the date of birth of any of his children and neither the Kotwari Register or the School Admission Register was presented in the court. Even the birth certificate presented was issued four months after the FIR, making its credibility questionable.
