Order to fill vacant posts of revenue courts of UP in one year, contempt action will be taken for non-compliance

Prayagraj. The Allahabad High Court has directed the officers of all revenue courts in the state to strictly follow the provisions of the Revenue Code. The State Government has been directed to fill the vacant posts of Deputy District Magistrate Judicial and Tehsildar Judicial within one year.

The court has directed the Chief Secretary to make the information about the order available to all commissioners and collectors. The court has also said that in the dispute filed under the Revenue Code, the officers have been banned from mentioning the provisions of the abolished UP Zamindari Destruction and Land Revenue Act.

The court has said that the period for disposal of different types of applications is fixed in the Revenue Code. The cases should be settled within the same period. The cases in which the time period is not fixed, should be settled in six months. The court termed the violation of the order as contempt of court. For which contempt action will be taken against the Collector, Commissioner and Revenue Council.

Justice Arun Kumar Singh Deshwal has given this order while disposing of Daya Shankar’s petition. The case of distribution of property under Section 116 is under consideration between the petitioner and Tilakdhari and others. This petition was filed demanding its early disposal.

The court said that the time limit for deciding each case is fixed in the Revenue Code. The hearing is getting delayed due to the strike of the lawyers and the absence of the officials. A large number of petitions are filed seeking early disposal of such cases. The court has directed to follow the time limit for deciding each application.
