Rahul Gandhi gets relief from Supreme Court, matter related to Home Minister Amit Shah
New Delhi. Leader of Opposition in Lok Sabha, Rahul Gandhi has got relief from the Supreme Court in a defamation case. This matter is related to the objectionable remarks made by Rahul Gandhi on Union Home Minister Amit Shah. The Supreme Court has stayed the proceedings of the Jharkhand Trial Court till further orders. Apart from this, the top court has also sought answers from the Jharkhand government and the petitioner in this matter. Both have been given four weeks to file their reply. The petition against Rahul Gandhi was filed by BJP worker Naveen Jha.
This matter is before the 2019 Lok Sabha elections when Rahul Gandhi in Jharkhand had cornered BJP by making objectionable remarks on the then BJP President Amit Shah in a speech. Rahul had said that BJP is the only party which can make a murderer the national president. Jharkhand BJP worker Naveen Jha had filed a criminal defamation case against Rahul Gandhi in Ranchi Magistrate Court. In this case, the court had issued summons to Rahul Gandhi and ordered him to appear. Rahul Gandhi had challenged this decision in the Jharkhand High Court but his petition was rejected there.
In this case, a non-bailable warrant was also issued against Rahul Gandhi by the Jharkhand Trial Court in February 2024. After this, Rahul Gandhi filed a petition in the Supreme Court demanding cancellation of the defamation case registered against him. Senior advocate Abhishek Manu Singhvi, appearing for Rahul Gandhi in the Supreme Court, argued that the complaint lodged against Rahul was filed by a third party and it is not acceptable to do so in a defamation case. After this, the Supreme Court stayed the proceedings of the Jharkhand Trial Court.
