Supreme Court On Hate Speech: ‘The petition containing only the statements of CMs of BJP ruled states is selective’, shock to Kapil Sibal from Supreme Court in hate speech case
New Delhi. Senior lawyer and Rajya Sabha MP Kapil Sibal got a setback in the Supreme Court. Actually, a petition was filed in the Supreme Court against hate speech. In this petition, only the statements of the Chief Ministers of BJP ruled Assam, UP and Uttarakhand were cited. Since the petition concerned only the case of CMs of BJP ruled states, the bench headed by CJI Surya Kant refused to hear it. The Supreme Court bench said that this is selective. The court said that the Constitution can be protected not only by putting a few faces in the dock, but only by changing the mentality of every party.
On Kapil Sibal’s petition, the Supreme Court said that this matter was not just about speeches. It is about that toxic environment which is challenging the dignity of democracy from social media to the streets. CJI Surya Kant’s bench told Kapil Sibal that the court welcomes fair and comprehensive petitions. It is not right in terms of justice to target only selected people and leaders of one ideology. The court asked Kapil Sibal to modify the petition, so that it can become a constitutional lesson for all political parties instead of a particular individual. Justice BV Nagarathna and Justice Jaimalya Bagchi of the bench said that speeches are based on thinking. Unless the thinking that goes against constitutional values is eradicated, nothing will be achieved by making guidelines.

However, the Supreme Court bench accepted Kapil Sibal’s argument that the atmosphere is becoming poisonous. The court also accepted Sibal’s point that it is necessary to fix the responsibility of social media. The court said that this has to be made a serious constitutional exercise instead of a populist exercise. In the petition, examples of words like Assam CM’s statement on Miyan Muslim, UP CM’s statement on Urdu supporters and Uttarakhand CM’s statement on land and love jihad were given. Kapil Sibal also said in the court that when the election code of conduct is not implemented, then what should be the responsibility of the media on the hatred spread through social media. When the court asked for changes in the petition, Kapil Sibal asked for time. Now he will file a petition demanding accountability and constitutional morality for all parties.
