Allahabad High Court on alimony: Important decision of Allahabad High Court on the maintenance allowance of a divorced woman and her child, said – lest it becomes an unbearable burden on the husband
Prayagraj. Divorce cases are increasing continuously and in such a situation, women are also going to court for alimony. According to the law, if a divorced woman does any work and can earn a good living, then her ex-husband will not have to pay alimony every month or in lump sum, but if the woman does not do anything, then the husband has to pay alimony. Generally women ask for a lot of maintenance allowance. On which divorced men are worried, now Allahabad High Court has said an important thing while hearing a case of alimony.
Justice Madan Pal Singh of Allahabad High Court, during the hearing of the alimony case, said that the amount of alimony should neither be so high that it becomes an unbearable burden for the husband nor so low that the wife and children are forced to live in poverty. Along with this, Allahabad High Court reduced the amount of Rs 16,000 fixed by the Family Court for the maintenance of a woman and child to Rs 8,000. In this case, divorcee Anil Kumar had filed a petition in Allahabad High Court. On April 22, 2025, the Family Court in Fatehpur, UP, under Section 125 of the Code of Criminal Procedure, had ordered to pay alimony of Rs 10,000 to the husband and Rs 6,000 to the son every month.

Anil Kumar had filed a petition in Allahabad High Court against the order of Fatehpur Family Court. Anil’s lawyer said in the High Court that his client’s monthly income is Rs 30 to 32 thousand. Paying Rs 16,000 every month is about 50 percent of the income. The lawyer argued that this alimony is too much. After hearing the arguments of Anil Kumar and the woman’s lawyers, the Allahabad High Court accepted that generally around 25 percent of the husband’s net income can be considered appropriate. On the basis of this, Allahabad High Court ruled to give Rs 8000 every month to the woman and child from the husband’s income.
