New Delhi. The decision has come on the petition of Aam Aadmi Party chief Arvind Kejriwal in which he had asked Justice Swarn Kanta Sharma of Delhi High Court to recuse himself from hearing the case. Justice Swarn Kanta Sharma did not recuse himself from hearing the case. While giving the verdict, Justice Sharma said that questions were raised on my impartiality, it would have been easy for me to recuse myself from the case, but this matter is not just his, but is related to the impartiality of the judiciary and the dignity of the institution.

Commenting, Justice Sharma said that while writing the judgment, I realized my responsibility as a judge, because I have taken oath on the Constitution of India. Therefore, she decided that she would give her decision only after hearing the application completely. She further said that I have decided that I will take the same decisions as I have been doing in my 34 years of career, without being influenced by all the allegations against me. However, some contradictory things were said during the arguments, which made it a bit complicated as the petitioner said that he did not doubt the honesty of the judge, but he wanted the case to be transferred. He said that this is a challenge to the institution of judiciary.

Justice Sharma said that in the case of Arvind Kejriwal’s arrest, the larger bench had not canceled his court order. He further said that if the order of a judge is canceled by someone higher than him, then the person who was prosecuted does not get the right to file a petition in the court saying that this judge is not fit to hear the case. Along with this, Justice Sharma also responded to the comments made by Kejriwal on his children. He said that if a leader’s children can enter politics, if a leader’s wife can enter politics, then why can’t a judge’s children enter the law profession?
