JPC Report On PM-CM Bill: Parliamentary committee is not in favor of removing PM, CM and ministers accused in serious cases, suggested taking this step


New Delhi. The 130th Constitution Amendment Bill was introduced in the Parliament by the Modi government at the Center in August 2025. In which a provision has been made that if the PM, CM or Minister is arrested, he will be removed from the post if he is not released till the 31st day. The opposition refused to pass the bill and it was sent to the JPC. Now JPC has prepared the report. Which is likely to be approved this week.

News18 channel has reported that the JPC has removed the provision of removal from office from the bill. JPC has said that on the 31st day of the arrest, the PM, CM and Minister should not be removed from their posts but should be suspended. The committee says that if the accused PM, CM and Minister are acquitted or the case is not heard within the stipulated time, then there should be a provision in the bill to automatically end the suspension of such office holders. She is in favor of replacing the word removal from the post with suspension. While giving the definition of serious crimes, the Parliamentary Committee has said that it should include those crimes for which the punishment is 5 or more.

According to the news of the channel, JPC has recommended that the provision of ending the suspension will ensure that the suspension of those who are not proven guilty in the court will also not be permanent. The committee has also suggested that a separate schedule be added to the bill. In which information should be given about those crimes of 5 years or more, due to which the accused PM, CM or Minister can be identified and suspended. Apart from this, JPC has also suggested in its report that under the instructions of the Supreme Court, special or fast track courts should be created to hear the cases of people holding high constitutional posts. So that the matter does not drag on for many years. Now it remains to be seen whether the Modi government amends the bill as suggested by the JPC or presents it as before.
