New Delhi. CJI Surya Kant got angry over what Patna High Court said about rape. Patna High Court had recently said in a case that trying to remove a woman’s salwar or pressing her chest cannot be considered as an attempt to rape. When this issue was raised in the Supreme Court on Tuesday, CJI Surya Kant got angry. CJI said that judges should also do some research. Actually, Allahabad High Court had also said the same thing in 2025. At that time, the Supreme Court itself had taken cognizance and said that judges should show sensitivity and should not give decisions by making such comments in cases related to women.

Even after the Supreme Court’s advice to the Allahabad High Court, the Patna High Court said the same thing. There has been an appeal against this in the Supreme Court. The CJI bench in the Supreme Court said that there is a report of the National Judicial Academy Committee. This report on sexual crimes should be uploaded on the websites of the Supreme Court and all High Courts. The Judicial Academy Committee has prepared this report after the Allahabad High Court’s verdict regarding rape. So that judges can be made sensitive in such matters. During the hearing in the Supreme Court, lawyer Shobha Gupta said that even after the order, it is being said like this. On this, CJI objected to the decision of Patna High Court.

CJI said that even the staff is not doing anything. Justice Surya Kant said that a handbook has been prepared. All High Courts and courts below them should follow it. Also, governments should order the police to follow this rule. This should also be kept in mind while registering cases and preparing charge sheets for crimes against women. CJI Surya Kant said that he will give a good decision in this regard and upload it. Patna High Court Justice Purnendu Singh had said in his judgment on July 9 that if someone tried to remove a woman’s salwar or pressed her chest, it would be considered as outraging the modesty and not an attempt to rape. Patna High Court had also canceled the punishment given to the accused.
