Rohingya Cji Comment Left Lawyers Open Letter

There has been panic among the leftist groups of the country after the recent hearing in the Supreme Court regarding Rohingya infiltrators living illegally in Delhi. A group of left-liberal lawyer-activists and some former judges have openly attacked the serious questions and comments raised by Chief Justice (CJI) Surya Kant during the hearing held on Tuesday (December 2) on the rights of people who entered India illegally.

More than 30 individuals, led by Prashant Bhushan’s organization Campaign for Judicial Accountability and Reforms (CJAR), have issued an open letter addressed to the CJI. It said that the comments made by the Supreme Court during the hearing are inhuman and dehumanize the Rohingya community. The signatories include former Chief Justice of Delhi High Court A.P. Shah, former Madras High Court judge K. Many well-known leftists including Chandru and former Patna High Court judge Anjana Prakash are included.

The Habeas Corpus petition was filed alleging disappearance of five Rohingya civilians allegedly detained by Delhi Police. The petition was filed by human rights activist Dr. Rita Manchanda. During the hearing, CJI Surya Kant had clearly said, “The government has not declared them refugees. If a person enters illegally by cutting a fence or making a tunnel, then is it the responsibility of the court to give him all the rights here?”

He had also said that India has its own poor citizens, whose rights and facilities are limited, and the court cannot give priority to such illegal immigrants over them. The bench also indicated that if such a petition on the Rohingya is accepted, similar claims would arise for those coming illegally from other countries.

Solicitor General Tushar Mehta opposed the petition saying that the petitioners are complete strangers and hence, they have no right to seek sensitive deportation related information. The Supreme Court adjourned the hearing till January.

The letter prepared by CJAR said the court equated vulnerable refugees with infiltrators and such comments raise fears of bias in the judiciary. The letter claims that the Rohingya people are refugees, whether the Indian government grants them this status or not. According to the Left’s letter, refugee status is declaratory and a person can be considered a refugee on the basis of self-declaration.

The letter cited the United Nations calling the Rohingya community the world’s most persecuted minority and the International Court calling Myanmar’s actions ethnic cleansing. The signatories demanded CJI Surya Kant to reaffirm human and constitutional values.

Apart from Prashant Bhushan, the signatories of the letter include many names who have long been known for leftist activism and controversial petitions in the court, such as Rajiv Dhawan, Colin Gonsalves, Chandra Uday Singh, Kamini Jaiswal, Gautam Bhatia and Shahrukh Alam. These individuals have often been accused of standing in favor of illegal immigrants and foreign groups on issues related to national security.

With the Supreme Court raising direct questions on the legal status of Rohingya, and now with the Left groups coming together to attack the CJI, it is clear that the Left is in favor of giving the infiltrators the same rights as Indian citizens.
