Refusal to cancel FIR against Muslim girl students; Hindu girl pressured to convert to Islam
The Allahabad High Court has recently expressed concern over the increasing religious fanaticism among the youth of the country, calling it a worrying trend. The court made this comment during the hearing of writ petitions filed by two Muslim students named Alina alias Alina Parveen and Shabia seeking cancellation of the FIR registered against them. An FIR was registered against these girl students studying in class 12 under the Uttar Pradesh Prohibition of Conversion Act, 2021 for imposing religious faith on their Hindu friend.
Justice J. J. The bench of Justice Munir and Justice Tarun Saxena rejected the petition of these girl students. The court said that prima facie a case is made out against him, hence the investigation cannot be interfered with. Dismissing the petition, the court said, “If such a tendency is visible among the youth, then it is even more worrying. This is the time of life when they should focus on developing their abilities in various fields of education and prepare themselves for the service of the society and the nation.”
The High Court, in its order dated April 16, 2026, also clarified that the Uttar Pradesh Prohibition of Illegal Conversion Act, 2021 is important to prevent such cases where people try to impose their religious beliefs on others. The court said, “This law was enacted to control the serious situation arising in the society, where some people, instead of practicing or propagating their religion, try to impose it on others, because they think that their religion should be followed by everyone.”
The court also said that this law was the need of the hour to deal with problems like religious pressure and forced conversions. The court said, “If a law designed to prevent such an emerging social menace is stopped at its nascent stage, its very purpose would be defeated.”
What is the matter?
The victim’s brother had lodged an FIR under sections 3 and 5(1) of the Uttar Pradesh Act at Bilari police station in Moradabad on January 22, 2026. According to the complaint, the accused girl students were studying in a coaching center along with her sister Kumari Mahima. She alleged that they forced her sister to wear burqa and pressurized her to convert to Islam. He also expressed apprehension that there could be some big conspiracy behind this.
Denying the allegations, Alina said that the FIR has been lodged against her out of revenge for rejecting the alleged love proposal made by the victim’s brother. She also alleged that the victim’s brother stalked her and had even proposed marriage to her.
The victim, in her statement before the Judicial Magistrate, gave details of the incident of January 20, 2026. According to her, after the coaching, her friend Alina and her four other friends Malishka, Shabia, Rimsha and Zehra took her to a restaurant for breakfast. Before going there, Alina forcefully asked her to wear burqa. When she refused, everyone together made her wear a burqa.
According to the victim, the accused girl students constantly inspired her to accept Islam. She tried to convince him by saying that her religion was better. He gave information about the Quran and said that it can be read completely in 40 days. Apart from this, she also forced him to eat non-vegetarian food.
The court also examined the CCTV footage of the place where the victim was allegedly made to wear the burqa. The court also noted that although Alina accused the victim’s brother of stalking her and proposing marriage to her, she did not lodge any official complaint or FIR in this regard.
