Ya Allah Dahi Bhalla Is Not An Insult To Religion Court Grants Bharti Singh And Shekhar Suman Major Relief

Mumbai High Court has given big relief to comedian Bharti Singh and actor Shekhar Suman. The court has ordered to cancel the FIR registered in the year 2010. During the hearing of this case, the court made it clear that the comments made for the purpose of humor, satire and rhyme do not have the intention to hurt the sentiments of any community.

Hearing the case, the court said that the words (Ya Allah! Rasgulla! Dahi Bhalla!) which were said to be objectionable were used only for the sake of rhyme and humour, as stated by the petitioners. The court said that ‘Dahi Bhalla’ and ‘Rasgulla’ are common food items which are eaten by people of all communities.

The argument of the petitioners on this is undisputed. There is no religious context to these words and this argument cannot be ignored. Simply mentioning food items in a comedy cannot be considered an insult to religion. It is necessary to present concrete evidence to prove that these words were used with the intention of insulting.

The court also acknowledged that easy access to artists has made it easier to target them, but misuse of the criminal law is also wrong. The court further said that the program was being telecast as a family entertainment show and had been running for quite some time. The petitioners argued that the purpose of the artists and judges in such programs is only to generate humor.

In its order, the court said that the FIR registered on November 27, 2010 at Pydhoni police station for the offense punishable under Section 295-A read with Section 34 of the Indian Penal Code and all proceedings related thereto are quashed and quashed.
