90,000 taxpayers get back wrongful deductions worth Rs 1,070 crore

New Delhi New Delhi: According to sources, around 90,000 taxpayers have voluntarily withdrawn wrong deduction claims worth around Rs 1,070 crore in their ITRs and paid excess tax. Under the provisions of Section 139(8A) of the Income Tax Act, 1961, taxpayers can file updated returns within two years from the end of the relevant assessment year to rectify errors of omission or commission. Investigation of the email clusters revealed that in most of the cases, the clusters belonged to individuals who were working in some general organisations, sources said, adding such organizations were PSUs, large corporations, MNCs, LLPs, private limited companies and even ​​that are in diverse sectors including government organizations and statutory bodies. Field offices were requested to obtain the list of common employers identified during investigation in email based clusters from the respective PDIT (Investigation) charges under the jurisdiction and to sensitize the employers about wrong claims of deduction in ITR. Organize outreach programs.

According to sources, the investigation conducted by CBDT has revealed more information about fake claims of deduction in ITR. Analysis of the information available with the Department has revealed that there is a huge difference between the total deductions under section 80GGB/80GGC claimed by the taxpayers in their ITR and the total receipts shown by the taxpayers in their ITR. Similarly, the deduction claimed under sections 80C, 80E, 80G also appears to be of doubtful nature.

Based on the analysis, a list of common employers (i.e., TDS deductors) has been identified. The list has been identified keeping in mind the objective to reach out to as many individuals as possible who are suspected of claiming fraudulent deductions under sections 80E, 80G, 80GGA, 80GGC and other deductions.

According to sources, to further promote voluntary tax compliance and reduce litigation, the department is launching an intensive outreach program targeting employers, to create greater awareness and ensure compliance with tax laws .
