A case was filed in the Supreme Court in this regard alleging that the directions of the Commission for Air Quality Management (CAQM) were not being followed, especially in the National Capital Region.

This matter came up for hearing in the Supreme Court yesterday. At that time, Solicitor General and Chief Secretaries of Punjab and Haryana state governments appeared in the court on behalf of the Central Government. When the judges said, “There is a law that does not allow burning of crop waste. Violation of the law is punishable by fine. But there are no strict rules. Burning of crop waste by farmers without regard to laws and regulations causes air pollution not only in the respective states but also in the neighboring states. Due to the absence of strict laws and their poor implementation, crop waste is continuously burnt. He questioned what measures the Central Government has taken so far to control burning of crop waste.

According to this, the Solicitor General, appearing on behalf of the Central Government, told the court that the Central Government will issue new rules in the next 10 days regarding imposing heavy penalty on burning of crop waste under the Air Quality Management Authority Act. The judges then said, “Living in a clean and pollution-free environment is a fundamental right of all citizens. It is the duty of the Central and State governments to maintain the rights of citizens,” he said.

Why did the officials not follow the order to stop burning of crop residue in Punjab and Haryana? Commission for Air Quality Management (CAQM) said that we have sent notices to various officials concerned as to why strict punitive action should not be taken against them. The judges then said, “The state governments of Punjab and Haryana are not taking adequate action against those who burn crop waste. He condemned that although laws are in place, no significant cases have been registered.

1080 FIRs: When the judges told the then Chief Secretary of Punjab, “Out of 1080 First Information Reports (FIRs) filed in Punjab regarding crop waste burning, only 473 persons have been fined. The remaining more than 600 individuals were not prosecuted. You save them. We openly accuse you of sending a signal that nothing will be done against those who break the law. “This case has been going on for the last 3 years,” the judges deplored.
