Badlapur Encounter: Bombay High Court raised questions, said- at first glance there seems to be some irregularity, it cannot be called an encounter

Mumbai. Akshay Shinde, the accused in the Badlapur School Sexual Harassment case in Maharashtra, has been killed in an encounter. Akshay's father has filed a petition in the Bombay High Court against this encounter, which is being heard on Wednesday. The High Court raised questions on the encounter and said that there seems to be some irregularity in it.

Advocate Amit Katarnaware, appearing for Akshay Shinde, has told the court that the CCTVs of all the shops at the time of taking Akshay Shinde into custody from Taloja jail and at the time of the incident should be immediately preserved. Akshay Shinde was met by his family in jail. He said that on the date of the incident, he talked to his parents and asked when he would get bail? My case is that he was not in a mental state to do anything, as claimed by the police that he snatched the pistol and fired at the officers.

Amit Katarnaware told the court that Akshay had asked his parents for Rs 500 so that he could avail the canteen facility and eat whatever he had to. He was in no condition to run away and neither did he have the physical strength to snatch the pistol from the police officer. Akshay has been murdered in view of the upcoming elections.

Akshay Shinde's father's lawyer said that it is clear that he is demanding an investigation into the fake encounter. An independent investigation should be conducted by senior officers in the CID or any other police station, as required to be done under the law. The High Court has the right to give directions for the formation of an SIT. The police registered an FIR against the accused under Section 307, but the father's complaint for registering the FIR is still pending.

He said that the SIT has failed to provide justice to the victim. Therefore, both should be investigated together. The lawyer appearing on behalf of the Maharashtra government told the court that the CID has already started the investigation. One case is registered under 307 and the other is an Accidental Death Report (ADR).
