Men can have more than one marriage! Bombay High Court gave its decision
A young man approaches the High Court and files a petition for registration of his third marriage. After this, the court also accepts his petition and gives its verdict that men can get more than one registration of marriage. The whole matter is related to the Bombay High Court, where a Muslim youth is allowed to register more than one marriage.
According to the HC, the personal laws of Muslims allow them to perform four marriages at a time. This decision came during the hearing of a petition in which a Muslim man had demanded registration of his third marriage. This marriage took place with an Algerian woman in February 2023, but it was refused to be registered on the basis of a marriage act of Maharashtra.
what is the whole matter
Actually, Thane Municipal Corporation had refused to register this marriage. The Maharashtra Matrimonial Bureau and Marriage Registration Act refers to a single marriage, and does not refer to multiple marriages. In such a situation, during the hearing on October 15, the bench of Justices BP Colabawala and Somshekhar Sundarshan declared this decision of the Municipal Corporation completely wrong.
The bench said that this Act does not prevent Muslim men from registering more than one marriage, because under Muslim personal law, they are allowed to have four wives at a time. The court says, “Under Muslim personal law, Muslim men have the right to marry four at a time. In such a situation, we cannot accept the argument of Thane Municipal Corporation that in the case of a Muslim man, only one marriage can be married under this Act. “Can be registered.”
Already registered for second marriage
Apart from this, the court also informed that Thane Municipal Corporation had earlier registered the second marriage of the petitioner. The court has directed the couple to submit all the necessary documents within two weeks. Following this, the Municipal Corporation was ordered to issue the marriage certificate within 10 days or reject it after a personal hearing. Meanwhile, no strict steps will be taken against the woman.
