A bench of Justices Abhay S Oka, Ahsanuddin Amanullah and Augustine George Masih expressed concern to the Chief Secretary of Punjab regarding the FIR lodged against about 1,080 violators.

The court said only nominal fines have been recovered from 473 persons, which shows that more than 600 violators are still not punished.

Judges warned that this sends a message to violators that there will be no consequences for their actions, and this has been the case for the past three years.

Justice Abhay Oka, according to Live Law, said, “The Union of India has not created any mechanism. The Environment Protection Act has become powerless. You have replaced penalty with fine by amending Section 15 and the procedure to be followed for imposing fine cannot be followed.”

Moreover, the top court strongly criticized the Punjab and Haryana governments for not taking any action against stubble burners. It said that if these governments were actually interested in enforcing the law there would have been at least one lawsuit.

The Supreme Court told the Chief Secretary of Punjab that “FIR was registered against about 1080 violators, but you have collected nominal fine from only 473 people. You are letting go of 600 or more people. Let us tell you clearly. That you are giving a signal to the violators that nothing will be done against them. Justice Oka also questioned the Punjab Chief Secretary and sought an explanation for giving a false statement to the Punjab Advocate General regarding the demand for funds from the Central Government for tractors and diesel for farmers.
