Supreme Court's big decision regarding Aadhaar card, High Court's order rejected

The Supreme Court of the country gave an important decision regarding Aadhaar. The Supreme Court rejected the decision of the Punjab and Haryana High Court which had accepted Aadhaar card as determining age for giving compensation to road accident victims. The court said that Aadhaar cannot be considered a sufficient document for age.

A bench of Justices Sanjay Karol and Ujjal Bhuiyan ruled that under Section 94 of the Juvenile Justice (Care and Protection of Children) Act 2015, the age of the deceased should be determined from the date of birth mentioned in the school leaving certificate.

The bench said that we find that the Unique Identification Authority of India, vide its circular No. 8/2023, in an office memorandum sent to the Ministry of Electronics and Information Technology dated December 20, 2018, has stated that Aadhaar card as proof of date of birth Although it can be used to establish identity.

What decision did the High Court give?

MACT had given compensation of Rs 19.35 lakh to Rohtak, which was reduced by the High Court to Rs 9.22 lakh because it was found that MACT had wrongly calculated the age of the deceased. The High Court had stated the age of the deceased to be 47 years.

MACT's decision remains intact

The top court, which was hearing an appeal filed by the family members of a man who died in a road accident in 2015, accepted the submissions of the claimant-appellants before it on the issue of determining age and referred the matter to the Motor Accident Claims Tribunal (MACT). ) also upheld the decision.
