Order: Aadhaar card not a valid document to determine age: Supreme Court

Order: The Supreme Court has said in an important decision that the age of a person cannot be determined on the basis of the date of birth mentioned on the Aadhar card. A bench of Justice Sanjay Karol and Justice Ujjwal Bhuyan said that age should be determined as per the date of birth given in the School Leaving Certificate (SLC).

This decision came in a case related to compensation in a road accident, in which the Punjab and Haryana High Court had reduced the compensation amount considering the date of birth written on the Aadhaar card as correct. The accident occurred in 2015, and the Motor Accident Claims Tribunal (MACT) had ordered a compensation of Rs 19.35 lakh on the basis of the School Leaving Certificate. However, on the appeal of the insurance company, the High Court reduced the compensation to Rs 9.22 lakh, considering the date of birth of the Aadhar card as valid.

The Supreme Court overturned this decision, upheld the decision of MACT and restored the compensation amount to Rs 19.35 lakh. The Court clarified that for determining the age, the date mentioned in the school leaving certificate under Section 94 of the Juvenile Justice Act, 2015 should be preferred and not the date given in the Aadhaar card.
