Ziauddin murder case: Body injuries increased the pain of policemen
Ambedkarnagar. The death of Azamgarh resident Ziauddin in police custody raised questions on the entire system. Even though the officers continued to deny torture in custody. But in the post-mortem report, the deep injury marks found on Ziauddin's body became a noose around the neck of eight policemen. CJM has also mentioned this prominently in his order. To trace the accused in the robbery case, the SWOT (Special Weapons and Tactics) team reached Hajipur Kudrat village of Powai police station area of Azamgarh district on 24 March 2021.
Local youth Ziauddin was arrested and kept in Sammanpur police station away from the headquarters. According to family members, Ziauddin was beaten continuously in the police station. The next day he died and the police admitted him to the district hospital. He died there within some time. On the complaint of Ziauddin's brother Shahabuddin, a case of murder and kidnapping was registered against all the eight policemen in Akbarpur Kotwali. , After this all the policemen fled. The investigation of the case was started by the then Akbarpur Kotwali in-charge Sanjay Pandey.
But later the responsibility was given to court security in-charge Birendra Bahadur Singh. A few days later, as soon as he became the head of Bewana police station, he gave a clean chit to all the policemen and filed the final report in the court on October 2, 2022. Shahabuddin filed a petition in the court against this report. CJM Sudha Yadav canceled the investigation while hearing it. He raised the question that how Ziauddin died is not clear from the analysis. There is no clear reason even in medical examination. It is also not clear how a total of eight injuries were caused on the body.
Even with reference to these injuries, no statement of the medical expert is recorded. It is also not true that these injuries can lead to heart attack. Due to the court order, the problems of the concerned policemen have increased. Most of the accused policemen are posted in different districts. Now that everyone will be facing murder charges, reports will also be sent to the concerned districts. This will also adversely affect their deployment. He may also be arrested.
The court also raised questions on the deliberations
During the hearing, CJM raised questions on the deliberations. Asked what was the location of the mobile phones of the deceased and the accused policemen at the time of the incident. The investigator did not provide the investigation report in this regard. Ziauddin was young and there is no evidence of any serious illness in the past. There is no mention of his consumption of alcohol or any other drug. In such a situation, the police investigation appears incomplete and flawed.
Police was demanding three lakh rupees to release him
Ziauddin's wife Fujaila told on telephone from Azamgarh on Saturday that her husband had called and told that the police were demanding Rs 3 lakh. If the money is not given immediately, these people will kill you. After this we all became worried. They were circling the Azamgarh Police. But no one was ready to tell anything. A call came on the night of 25 March. It was told that the husband had a heart attack. Come to the hospital immediately. We went to Powai police station in Azamgarh.
From there went to Jaitpur. But we had no idea where we had to go. Later no one was receiving the number from which we had received the call. After a lot of efforts, when the information reached Ambedkar Nagar District Hospital, the husband's body was found there. Son Faiz and daughter Atufa are still unable to answer what was their father's fault for which the police killed him.
Police had set the price up to Rs 50 lakh
Ziauddin's brother and plaintiff Sue Shahabuddin told that the police had put the cost of his brother's death at Rs 50 lakh. The accused policemen were continuously contacting for reconciliation. Were ready to give up to fifty lakh rupees. Many big white collar and mafia also put pressure for reconciliation. What would we do with the money? We did not deal with my brother's death. Shahabuddin said that we knew from the beginning that the police would acquit all the accused after filing a final report in the case. We had faith in the court. The disappointment continued. But hope remained from the court. The court did justice to us.
This is the whole matter
Pradeep Kumar was robbed in Jaitpur area. A total of four accused were made in this. Police arrested three accused. Police was searching for Qamar Rasid, a resident of Nizamabad in Azamgarh district. Police got information about Ziauddin's conversation through Qamar's mobile. In such a situation, while trying to reach his waist, Ambedkar Nagar police went to Azamgarh and caught Ziauddin. Ziauddin was accused of torturing him just to know the location of Qamar Rashid. On the other hand, Kamar, who was wanted for robbery, was later killed by the police in an encounter in Jaunpur.
The family members were also disappointed by the magisterial investigation.
Even the magisterial inquiry into the death of Ziauddin of Azamgarh in police custody could not provide any relief to the family. All the procedures were adopted in the name of investigation, but according to the plaintiff, the entire exercise was focused on saving the guilty policemen. When the allegations of death of a youth due to beating in police custody gained momentum, the then DM Samuel Paul N issued an order for a magisterial inquiry. . He appointed the SDM of Tanda as the investigating officer. An investigation was conducted but this investigation also went in favor of the policemen. Ziauddin's relative Dr. Afaq says that in the magisterial investigation, statements etc. were recorded, but from the very beginning the attitude of the investigation was to help the policemen.
No direction was given to decide justice. We also knew that the magisterial inquiry was just a sham. Only food will be supplied. Yet, when we went at the appointed time, all the statements recorded by us were not taken into proper cognizance. Ziauddin's brother Shahabuddin says that we were only made to run in the name of magisterial inquiry. As a gesture, the officers had also said not to worry. Nothing is going to happen. At the same time we realized that such investigation is only meant to mislead and cool down the matter. Therefore no one in the family had any hope from the magisterial inquiry. We had even sent a letter to the Human Rights Commission, but I don't know what report or input the police administration gave that we could not get any help from there either. Now we have got a victory from the court. We are confident that the court will now give appropriate punishment to those who murdered my brother.
