SC reprimands Yogi government for demolishing houses! Order given to give compensation of so many lakhs
In a strong condemnation of the UP government, the Supreme Court has condemned the unauthorized demolition of private houses for the road widening project. The Supreme Court described this act as “atrocious”. In its conclusive judgment, the court has ordered the UP government to pay an interim compensation of Rs 25 lakh to the petitioner, whose house was demolished without due legal process.
CJI Chandrachud rejected the petition of Yogi government
Emphasizing the need for accountability, the court has directed a disciplinary inquiry into the actions of the officers concerned. Chief Justice of India DY Chandrachud has questioned the state government, “How can you enter someone’s house and demolish it without following proper procedure or without giving notice?” Let us tell you that the UP government had requested for an adjournment, but CJI Chandrachud rejected the petition and said that the court must evaluate the material already presented to assess the legality of the demolition.
Confirmed in NHRC report
The court found serious procedural violations in the state’s actions. The UP government has not provided documents confirming the original width of the state highway, details of any investigation into the alleged encroachments, or evidence that the required land was legally acquired before the demolition. Furthermore, no information was provided regarding the size of the applicant’s property, which was stated to be within the center line of the highway. The court found that the demolition had crossed the limits of alleged encroachment, as confirmed by the NHRC report.
