Latest News :- The Constitution bench of the Supreme Court has ruled that the government has no power to acquire private property for the 'public good'. The matter related to this came up for hearing before a constitutional bench of 9 judges headed by the Chief Justice of the Supreme Court. Supreme Court Chief Justice DY Chandrachud, Justice P.V. Nagaratna, Sudhanshu Dhulia, Hrishikesh Roy, JP. Nine judges including Pardiwala, Manoj Mishra, Rajesh Pindal, SC Sharma, AG Masih heard the case. The verdict was announced today at the conclusion of the arguments. The verdict was given in the ratio of 7:2.

Three separate decisions were written. The Chief Justice wrote the judgment for himself and six fellow judges. Judge BV Nagaratna wrote the decision alone. Justice Sudanshu Dhulia wrote the dissenting judgment. A 7-judge bench, including Chief Justice Chandrachud, ruled that the government does not have the power under the Constitution to take over all privately owned resources for public good. However, the 7-judge bench also ruled that the government cannot tax Can lay claim to personal property in exceptional cases.

With this, a bench headed by Chief Justice Chandrachud overturned the earlier decision of Justice Krishna Iyer that the government can acquire all privately owned resources under Article 39 (B) of the Constitution. At the same time, Justice PV Nagarathna partially disagreed with the decision of the majority of judges, including the Chief Justice. Whereas Justice Sudanshu Dhulia has given separate verdict on all aspects.
