New Delhi. Supreme Court big decision: The Supreme Court has passed an important order in cases of sexual harassment involving women and minors. The court directed the trial court to give compensation to the rape victims under CrPC as soon as possible. The court directed the district and state legal services authorities to expeditiously implement the directions to ensure that victims in such cases get compensation at the earliest.
Justice BV Nagarathna and Justice Pankaj Mittal were hearing the bail plea of a rape convict under the Child Protection Act. Meanwhile, when the bench was told that the sessions court had not directed to give compensation to the victim while delivering the verdict (Supreme Court big decision), Justice Nagarathna expressed displeasure and said that it was a big mistake. He said that the rape victim should get compensation under Section 396 of the Indian Civil Code. The court directed all the district courts to give compensation to the victims in such cases.
The court was hearing the bail plea of Saibaz Noor Mohammad Shaikh, who was convicted of raping a 13-year-old girl in Maharashtra in 2020. The court was told that at that time the trial court had not given any direction regarding compensation to the victim. Justice Nagarathna called it a big mistake of the Sessions Court and directed the Bombay High Court to look into the case of the victim and give her compensation.
The Supreme Court further said in the order that the notice should also be given to the District Legal Services Authority (DLSA) or the State Legal Services Authority (SLSA). The court directed the registry to circulate the order to the registrars of all high courts. It has been said in this notice that compensation should be given to the rape victims as soon as possible.
