The Supreme Court is going to give its verdict today in the case of changes in the Preamble of the Constitution through the 42nd Amendment during the Emergency. A petition was filed in the Supreme Court saying that the Preamble of the Constitution was changed illegally by Indira Gandhi's government. In fact, during the Emergency, when the opposition leaders were in jail, Indira Gandhi's government had brought the 42nd Constitutional Amendment Bill in the Parliament session in 1976 and got it passed. After this bill was passed, the Preamble of the Constitution was changed.

The words 'socialist' and 'secular' were added to the Constitution after the Indira Gandhi government passed the bill. Whereas, earlier these two words were not there in the Preamble of the Constitution implemented in 1950. The petitioners say that when the Emergency was imposed, the Preamble of the Constitution was changed unilaterally. The petitioners have also argued in the Supreme Court that a particular political ideology like socialism cannot be made a part of the Constitution. At the same time, he has also said that the Preamble of the Constitution was approved by the then Constituent Assembly on 26 November 1949. In such a situation, it was not right to change the Preamble without changing that date. At the same time, during the hearing in the Supreme Court, the judges had made important remarks that socialism can be considered as a welfare state.

The controversy over changing the Preamble of the Constitution and adding the words socialist and secular in it has been going on for a long time. Many people have been raising their voice against such changes. The reason for this is that during the Emergency, Indira Gandhi's government had sent opposition leaders to jail and when the Preamble of the Constitution was being changed, the number of leaders present in the Parliament from the opposition was not so much that they could support Indira Gandhi.
