Retired High Court judges get only Rs 10 to 15 thousand as pension, this is a very pathetic situation: Supreme Court

New Delhi. The Supreme Court on Wednesday expressed disappointment over the pension of retired High Court judges. The court said that retired High Court judges are getting only 10 to 15 thousand rupees as pension. This is a very pathetic situation.

A bench of Justice BR Gavai and Justice KV Vishwanathan said that it is not right to adopt a legal approach in every case. In some cases a humanitarian approach should also be adopted. The Supreme Court on Wednesday heard the petition related to the pension of High Court Judges. During this, Attorney General R Venkataramani, appearing for the government, requested the bench to hear the case in January. The government will try to resolve this issue.

On this the bench said that it would be better if you explain to the government that our interference should be avoided. This matter will not be decided on a case-by-case basis and whatever decision the Supreme Court gives will be applicable to all High Court judges. After this, the bench listed the case for hearing on January 8.

The issue has come up before

The issue of pension of retired High Court Judges has already been raised in the Supreme Court. Last month, during the hearing of a petition, the Supreme Court had expressed surprise that some retired High Court Judges were getting a nominal pension ranging from Rs 6,000 to Rs 15,000. The Supreme Court was hearing the petition of a retired High Court judge.

What was said in the petition?

The petitioner, a retired judge of the High Court, had said in the petition that he has retired from the High Court and he is getting a pension of only Rs 15,000. He was elevated as a judge of the Allahabad High Court after serving as a judicial officer in the district court for 13 years. He had claimed that the authorities did not consider his judicial service while calculating his pension. On this, the bench had said that we have retired High Court Judges in front of us, who are getting pension of Rs 6,000 and Rs 15,000, so this is shocking. How can this be possible?

Pension should be calculated on the basis of last salary

Hearing a separate petition in March, the Supreme Court had said that there cannot be any discrimination in calculating the pension benefits of retired judges of high courts on the basis of whether they have been promoted from the Bar or the district judiciary. The pension benefits of retired High Court Judges promoted from the District Judiciary should be calculated on the basis of their final pay.
