Atul Subhash's mother reached Supreme Court, filed petition for custody of grandson, notice issued to three states..

New Delhi:- After the suicide of Bengaluru engineer Atul Subhash, his mother has approached the Supreme Court for the custody of her four-year-old grandson. Atul Subhash had committed suicide on December 9 after making serious allegations against his wife Nikita Singhania and her family.
After this, there was a lot of uproar on social media and demands were made to provide justice to Atul. Now the Supreme Court will hear the petition of Atul's mother on January 7.

This matter came before the bench of Justice BV Nagarathna and Justice N Kotishwar Singh. The apex court has issued notices to the governments of Uttar Pradesh, Haryana and Karnataka regarding this matter. The bench has scheduled the next hearing of the case on January 7. Subhash has left videos and written notes accusing his wife and in-laws of harassment and false allegations.
Subhash's mother Anju Devi has filed a habeas corpus petition to secure the custody of her grandson, whose address is unknown. Anju Devi approached the top court through advocate Kumar Dushyant Singh and was represented by senior advocate Gaurav Aggarwal before a bench led by Justice Nagarathna.

Atul Subhash's mother argued in the petition that she is demanding issuance of habeas corpus petition to the respondent police officers, so that her 4 years 9 months old grandson can be found and produced. Who was kept in illegal custody at the behest of his mother Nikita Singhania, Atul's wife.

The petition argued that the petitioner's grandson was deliberately kept away from the reach of his biological father by his mother, causing him severe mental anguish. The petition said that Atul faced severe mental harassment and cruelty at the hands of his wife.

The petition also claims that neither Subhash's estranged wife Nikita Singhania nor his family members, who are currently in custody, have disclosed the whereabouts of the child.

The plea further states, “It is submitted that while the case stands as follows, the biological father and natural guardian of the subject corpus… are no longer alive and his biological mother is arrested and in custody, including the maternal grandmother , who have been arrested and are in custody. The petitioner, who is the maternal grandmother of the child, has approached this Court through this petition, fearing for the life and liberty of the said child, whose whereabouts are unknown.

Nikita Singhania, her mother Nisha Singhania and brother Anurag Singhania were arrested on 16 December. Citing evidence from the suicide note and video left by Subhash, Karnataka Police accused him of abetting suicide. He is currently in judicial custody. Atul's mother said in the petition that, in all likelihood, the mother has kept her child in unknown custody. He said that Nikita Singhania is not entitled to custody.

The plea said, “It is submitted that, in the present facts and circumstances of the case, where his father has died and the mother has been arrested by the respondent police. In such a situation, the mental well-being of the minor child should be given utmost importance and hence the petitioner is best suited to take the custody of the child.

At the same time, Atul's father Pawan Kumar has also publicly demanded the custody of the child. Atul's family has alleged that Nikita and his family harassed them by filing false legal cases and demanding money.
