SUCO bans agreement between Center and Delhi government

Prime Minister Ayushman Bharat Health Infrastructure Mission: The Supreme Court has directed the Delhi High Court to sign a Memorandum of Understanding (MoU) with the Central Government to implement the 'Prime Minister Ayushman Bharat Health Infrastructure Mission (PM-ABHIM) scheme. The court order was stayed on Friday. A bench of Justice BR Gavai and Justice Augustine George Masih passed this order regarding the stay on the petition filed by the Delhi government. The bench issued a notice to the Central Government in this matter and sought its reply.
All seven Bharatiya Janata Party MPs from Delhi had filed a petition in the high court seeking directions for the implementation of the Ayushman Bharat scheme. On this basis, the High Court had given instructions to the Delhi Government in December 2024. Senior advocate AM Singhvi, representing the Delhi government on the petition challenging this order before the top court, argued, how can the High Court force me (Delhi government) to sign an MoU with the Central Government. He further said that the High Court has redefined the powers of the Delhi government. It has forced it to sign an MoU with the Central Government.
In this scheme, it has been made mandatory for the Government of India to give 60 percent of the capital expenditure and 40 percent for the Delhi Government.
Delhi's Aam Aadmi Party (AAP) government challenged the High Court's order of December 2024, which gave the Union Ministry of Health and Family Welfare a memorandum of understanding (MOU) by January 5 to implement the Ayushman Bharat scheme in the national capital. ) was instructed to sign. The court said that when 33 states and union territories have already implemented the scheme, it would not be appropriate not to implement it. The Delhi government has said that the Pradhan Mantri Jan Arogya Yojana will benefit only 12-15 percent of the city's population, due to which its impact will be limited. In contrast, the Delhi Arogya Kosh Yojana introduced by it (Delhi government) has 'wider and more far-reaching impact'.
