Guwahati : Opposition leader Rahul Gandhi has been in trouble over his recent statement in which he had said that BJP and RSS have captured every single institution, and now we are fighting BJP, RSS and the Indian state. An FIR has been registered against him at Pan Bazar Police Station in Guwahati. Rahul Gandhi had given this statement during the inauguration of the new headquarters of the Congress Party on Kotla Road, Delhi on January 15, 2025.
The FIR was registered under sections 152 and 197(1)D of the BNS for “acts threatening the sovereignty, unity and integrity of India”, which is a cognizable and non-bailable office. Complainant Monjeet Chetia alleged that Gandhi's statement crossed the limits of acceptable expression and posed a serious threat to public order and national security.

In his complaints, according to the FIR, Chetia said, “By declaring that their fight is against the Indian state, the accused has deliberately instigated subversive activities and rebellion among the people. “This is an attempt to undermine the authority of the state and portray it as a hostile force, creating a dangerous narrative that could incite unrest and separatist sentiments.”

Monjit Chetia also suggested that Gandhi's remarks were motivated by frustration with repeated electoral failures. As leader of the opposition, Gandhi has a responsibility to maintain public confidence in democratic institutions, but instead, he chose to take advantage of his platform to spread lies and incite insurrection, putting India's unity and sovereignty at risk. .
The complainant said, “Having failed to win public confidence through democratic means, the accused is now trying to incite discontent against the central government and the Indian state. This behavior is particularly worrying given her position as leader of the opposition, a role that comes with the responsibility of maintaining public confidence in democratic institutions. “Instead, the accused has chosen to take advantage of his platform to spread lies and incite insurrection, thereby endangering the unity and sovereignty of India.”

Chetia complained that Rahul Gandhi's comments are a direct challenge to the integrity and stability of the Indian state, which requires immediate legal action under Section 152 of the BNS.
