CBI will go to High Court against the decision of Kolkata rape-murder case, demands death penalty for Sanjay Roy
What is CBI's appeal?
However, not satisfied with the life sentence awarded by the Sealdah Court, the CBI has decided to appeal against the decision in the High Court. CBI says that they should give death penalty to Sanjay Roy, as this case was extremely heinous and serious.
Convicted of murder and rape of female doctor
The court had found Sanjay Roy guilty of murder and rape of a female doctor. This incident with the female doctor happened in 2023, when she was alone in the hospital during her duty. Accused Sanjay Roy, who was an employee of the hospital, made her the victim of rape and murder. There was outrage across the state after this incident, and local people demanded strict punishment in this case.
National Desk: The case of rape and murder of a trainee female doctor at RG Kar Hospital in Kolkata has now taken a major judicial turn. Sealdah Court on Saturday convicted the main accused Sanjay Roy in the case and on Monday sentenced him to life imprisonment. Besides, the court also imposed a fine of Rs 50 thousand on Sanjay Roy. The court also ordered that convict Sanjay Roy will have to remain in jail till his death.
Appeal against lower court order
At the same time, CBI opposed this argument of the state government and said that the state government does not have the right to appeal against the order of the lower court. The CBI argued that only the prosecuting agency can appeal on the term or type of sentence. CBI had already demanded death penalty for Sanjay Roy in the lower court, but the court sentenced him to life imprisonment.
Chief Minister Mamata Banerjee's tough stance
Earlier, West Bengal Chief Minister Mamata Banerjee had also taken a strong stand in this case and reached the High Court demanding death sentence to Sanjay Roy. Demanding justice in this case, he had appealed for death penalty on behalf of the state government. State government Advocate General Kishore Dutta had said that considering the seriousness of the case, Sanjay Roy should get death penalty.
Will listen to the arguments of the accused's lawyer
Now this matter will be heard in the High Court on 27 January 2025. A bench headed by Justice Debangshu Basak will hear the case and hear arguments from the state government, CBI, the victim's family and the convict's lawyer. The court will decide whether death penalty should be given to Sanjay Roy or not.
Order to pay compensation of Rs 7 lakh
Along with this, the court ordered a compensation of Rs 17 lakh to the victim's family. The state government has been asked to give this compensation to the victim's family. The Court also ensured that the victim's family gets justice, and for the same, they are entitled to appropriate compensation. This case raises a big question on the increasing cases of crimes against women in Kolkata. Civil society and political leaders have raised their voice regarding such heinous crimes in the state, and now the final decision on this matter will be taken in the High Court.
