  1. Gifts are for protection: Whatever money or jewelery the girl’s father gives at the time of marriage, even if it is given to the groom, its real purpose is to secure the daughter’s future.
  2. The husband is just a ‘trustee’: The court held that the husband is only a trustee of the property received during marriage, the wife is its real owner.
  3. Accounts to be completed: The court ordered Roshanara’s ex-husband to immediately return the cash and gold jewellery.

This decision is a ray of hope for millions of women who keep making rounds of courts for their belongings after divorce. Now the husband cannot make the excuse that “such and such a gift was given in my name.” The Supreme Court has given a clear message that the purpose of the law is not to entangle her in technical complications, but to ensure that a single woman gets her respect and rights.
