Apart from these, leaders like Upendra Kushwaha, Devesh Chandra Thakur, Lalan Kumar Saraf, Nitish Mishra, Sanjay Singh and Bhola Yadav are also included in the list. All the leaders have been taking their pension without any interruption for many years, whereas as per the rules, it is completely illegal to take pension while being a member of any House. Upendra Kushwaha is a Rajya Sabha MP and has been taking pension since 2005. He is an ally of NDA and President of Rashtriya Lok Morcha. Satish Chandra Dubey is currently the Union Minister of State in the Government of India. He was earlier an MLA and Lok Sabha MP, then joined the Rajya Sabha in 2019. Bijendra Prasad Yadav has been MLA from Supaul since 1990 and is currently the Finance and Energy Minister of Bihar.

JDU leader and Lok Sabha MP from 2024 Devesh Chandra Thakur is also the former chairman of the Legislative Council. Lalan Saraf is a senior JDU leader and Legislative Council member. Nitish Mishra is a BJP MLA and he claims that he is not getting pension right now. Sanjay Singh is JDU MLC and is a pensioner since 2018.

Life certificate will have to be submitted every year to prove that the pensioner is alive and eligible. Patna High Court senior lawyer Sarvdev Singh has called it a case of “economic offence”. He says that no respectable person can take pension while holding office. Despite this, if this is happening, then it is a violation of both pension rules and laws. Activist Shiv Prakash Rai, who filed the RTI, says that he has taken this information from government records and has made it public for transparency.

What did Netaji say on taking wrong pension?

According to Dainik Bhaskar, when contacted, most of the leaders did not receive their calls. However, some clarified that their pension has not been credited to their account or has been recorded incorrectly. In the conversation, Devesh Chandra Thakur and Nitish Mishra described this information as incomplete and said that if any pension has been credited to their account, they will return it.

Thakur clearly said that he never requested for pension. Along with this, Nitish Mishra claimed that he had received only one month’s pension in 2015, when he was not a member of any house. But he has not received pension since becoming a member of the House.
