This Friday, the Supreme Court rejected a PIL related to Artificial Intelligence (AI). The petition sought a ban on the ‘uncontrolled’ use of AI and machine learning in courts. The court said that they are well aware of the potential dangers of AI, but such issues can be better handled by administrative measures and not by court orders. Chief Justice Surya Kant and Justice Joymalya Bagchi heard the arguments of the petitioner. The petitioner argued that content generated by AI could have a negative impact on judicial processes and was being misused.

The lawyer who filed the petition said that AI sometimes generates judicial decisions that do not actually exist, and these decisions are later included in the documents. The Chief Justice acknowledged this concern and said that lawyers and judges will have to learn to scrutinize AI-generated decisions. For this, training can be arranged in the Judicial Academy. “We use AI very carefully and don’t want it to hinder our decision-making ability,” he said.

The Chief Justice clarified that AI can only be an assistive tool, but the actual judicial reasoning and decisions will always be taken by a human judge. The lawyer said that the lower courts have also started making references to ‘non-existent Supreme Court decisions’ many times. On this, the Chief Justice said that the judiciary is aware of these dangers and judges are being given continuous training. He also said, “Judges will have to cross-check everything. With time both the lawyers and we will learn.”
