Assam SIT Files Chargesheet in Zubeen Garg Death Case; Murder Charges Against Four

The Special Investigation Team (SIT) of Assam Police on Wednesday submitted a detailed chargesheet before the court in connection with the death of iconic Assamese singer Zubeen Garg, framing serious charges including murder, criminal conspiracy and destruction of evidence against multiple accused.

Addressing the media, Special DGP M.P. Gupta, who is heading the SIT, said that murder charges under Section 103(1) of the Bharatiya Nyaya Sanhita (BNSS) have been filed against four accused — Zubeen Garg’s manager Siddhartha Sarma, festival organiser Shyamkanu Mahanta, bandmate Sekhar Jyoti Goswami and co-singer Amritprava Mahanta.

“The SIT has brought murder charges against Siddhartha Sarma, Shyamkanu Mahanta, Sekhar Jyoti Goswami and Amritprava Mahanta after detailed investigation,” Gupta said.

According to the SIT, the accused acted with common intention and knowledge, and were part of a criminal conspiracy leading to the death of the artist. The chargesheet details the alleged motive, sequence of events, and roles played by each accused.

Two police security officers (PSOs) — Paresh Baishya and Nandeshwar Bora — have been chargesheeted under Section 316(5) for criminal breach of trust, along with conspiracy charges under Section 61(2).

The chargesheet also includes serious allegations against festival organiser Shyamkanu Mahanta, who faces additional charges of extortion, cheating and destruction of evidence.

Key charges framed include:

Sections 3(6), 3(7), 3(8): Common knowledge, intention and cooperation

Section 61(2): Criminal conspiracy

Section 103(1): Murder

Section 105: Culpable homicide not amounting to murder

Section 316(5): Criminal breach of trust

Section 238: Destruction of evidence

Section 308(2): Extortion

Section 318(4): Cheating

Special DGP Gupta revealed that the main chargesheet runs into over 2,500 pages, and with annexed evidence and exhibits, the total documentation exceeds 12,000 pages.

“We have placed on record detailed evidence, exhibits, and a clear account of the criminal conspiracy and motive behind the crime,” Gupta said.

The filing of the chargesheet marks a major development in the high-profile case, which has drawn widespread public attention across Assam. Further legal proceedings are now expected to follow as the court takes cognisance of the charges.
