Sunjay Kapur estate case: Priya Kapur’s opposition to forensic testing of Will under scrutiny

Sunjay Kapur estate case: Late business tycoon Sunjay Kapur’s Rs 30,000-crore estate case has taken a new turn. Fresh doubts have emerged over the authenticity of his alleged Will. Questions were raised after strong resistance to forensic examination by his third wife, Priya Sachdev Kapur. Conflicting statements from the document’s claimed executor also came before the Delhi High Court.

These developments have intensified scrutiny over the inheritance of Sunjay’s vast estate. This includes control over the Sona Comstar Group.

Priya Kapur opposes forensic examination of Sunjay Kapur’s Will

During submissions made on December 16 before the joint registrar of the Delhi High Court, Gagandeep Jindal, Priya Kapur was seen firmly opposing any forensic examination of the Will, despite it being the cornerstone of her claim to the late businessman’s personal assets. The plea for forensic testing was made by Sunjay’s children from his previous marriage, Samaira and Kiaan Raj Kapur, who have argued that scientific verification is essential to establish the document’s genuineness.

Legal experts following the case have described such resistance as unusual. In high-value probate disputes, courts routinely rely on handwriting, ink and paper analysis to remove ambiguity. Blocking this process, they say, only deepens suspicion around a Will that completely excludes Sunjay’s biological children.

Concerns have further escalated due to shifting accounts by Shradha Suri Marwah, named as the executor of the Will. On Tuesday (December 16), she formally sought to amend her earlier sworn statement, admitting that her previous version of how she first received the Will was incorrect.

Sunjay Kapur’s Will receipt timeline altered multiple times

Initially, Shradha had claimed the document was handed to her by Priya Kapur on June 24. This was later altered to state that it was received from Dinesh Agarwal on June 14. Now, after reviewing Priya Kapur’s submissions, Shradha has reverted to her original claim, once again naming Priya Kapur as the source. These reversals have raised eyebrows within legal circles.

Further complications have emerged from Shradha’s own admissions. She has conceded that she was unaware she had been appointed executor, did not have independent legal advice, and was unclear about the Will’s contents. Her request for indemnity from Priya Kapur and her stated belief that probate was unnecessary have fuelled concerns that standard legal safeguards were bypassed.

Karisma Kapoor’s children’s counsel flags legal invalidity risks

Counsel for Samaira and Kiaan, Mahesh Jethmalani, has argued that under Indian law, an executor cannot be appointed without prior consent. It has also been conceded in court that if the Will fails judicial scrutiny, Sunjay’s estate would devolve equally among all Class I heirs, including the children excluded from the disputed document.

The Delhi High Court is scheduled to hear both the forensic inspection plea and Shradha’s amendment application on January 20, 2026.

Sunjay Kapur, chairman of Sona Comstar, died on June 12, 2025, while playing polo in London. His passing has since triggered an intense legal contest over his multibillion-dollar legacy.
