Justice Yashwant Verma cash scandal: Challenge given to the investigation committee in the Supreme Court, hearing on January 7
Former Delhi High Court judge Justice Yashwant Verma, involved in the ‘cash scandal’ case, has filed a petition in the Supreme Court challenging the three-member committee constituted by the Lok Sabha Speaker. This matter is related to the process of removing Justice Verma from the post in Parliament. While hearing this petition, the Supreme Court has issued notices to the secretariats of both Lok Sabha and Rajya Sabha and sought their reply by January 7. The court has listed the matter for hearing in the first week of January. During the hearing, Justice Dipankar Dutta, while making oral remarks, said that do the law makers not even know that this cannot be done?
Justice Verma’s argument
Justice Verma argues that the current procedure adopted by the Parliament is wrong. He says that the process of removing a judge under the Judges Inquiry Act can proceed only when both the Lok Sabha and the Rajya Sabha accept the proposal and after that a joint committee is formed. But in this matter only the Lok Sabha has passed the resolution, whereas this resolution is still pending in the Rajya Sabha. Justice Verma also says that when the proposal for his removal was presented in both the Houses on July 21, a joint committee of both the Houses should have been formed for further investigation. In such a situation, constituting the committee only by the Lok Sabha Speaker is against the law.
What is the matter?
It is noteworthy that this year, there was an incident of fire in the government bungalow of Judge Justice Yashwant Verma in Delhi on the night of 14-15 March. While extinguishing the fire, the fire service found bundles of burnt notes from the store room, videos of which also went viral. At that time Judge Verma was not present in the bungalow and his wife informed the police and fire department. During investigation this cash was found to be unaccounted for. A week after the incident, Justice Verma was transferred from Delhi High Court to Allahabad High Court, where he has not been assigned any judicial work at present.
