Court stops Kamal Rashid Khan from posting defamatory material against Vashu Bhagnani

This order will remain effective until the final decision of the ongoing defamation case between the two parties. The court believes that such posts can harm a person’s image and personal rights.

Background of the legal dispute

This legal dispute started in 2021, when Vashu Bhagnani filed a petition in the court against Kamal Rashid Khan. Bhagnani alleged that Khan had written derogatory and defamatory things against him on social media and other digital platforms. Due to these posts his social image and professional reputation suffered. On this basis he sought intervention from the court.

Bhagnani requested the court to restrain Kamal Rashid Khan from publishing such material while the case is pending. Along with this, he also demanded that Khan be directed to tender an unconditional apology in writing. Bhagnani said that Khan’s continuous posts are causing mental stress and social loss for him.


Court’s comment

The City Civil Court clarified in its order that prima facie it appears that the comments made by the defendant affect the plaintiff’s right to privacy. According to the court, it is the responsibility of the justice system to protect the reputation of any person. No person can harm anyone’s image in the name of personal opinion by using a public platform. On this basis the court decided to impose an interim stay.

However, the court currently refuses to direct Kamal Rashid Khan to tender an unconditional apology. The court says that the question related to amnesty will be decided on the basis of evidence and facts available in the final stage of the trial. The court made it clear that it would not be appropriate to form any final opinion on this aspect now. Therefore this demand has been kept open.
