Judge’s order became controversial
Justice Swaminathan had on December 1 ordered that lamps be lit near the Arulmighu Subramanya Swamy temple. Controversy arose after his decision, due to which on December 9, several opposition MPs led by DMK submitted a proposal to Lok Sabha Speaker Om Birla for the removal of the judge.
Reaction of former judges
The former judges said in a joint statement that the move was “an attempt to intimidate judges who do not conform to the political expectations of a particular section of the society.” He said that if such action was allowed, it would prove detrimental to democracy and the independence of the judiciary.
Lok Sabha Speaker’s comment
Meanwhile, Lok Sabha Speaker Om Birla told reporters that the decision on the proposal to remove the court judge will be taken as per the rule of procedure. He also mentioned that there should be dialogue in the House and not confrontation.

Opposition parties like Congress, DMK and Samajwadi Party have raised questions on the impartiality of Justice Swaminathan regarding the verdict given on ‘Kartigai Deepam’. These parties made this proposal to the President because his conduct casts doubt on the primacy of the judiciary.
