Delhi HC strict on personality rights: Instructions given to immediately remove objectionable content of R Madhavan, many websites banned

Protecting the personality rights of actor R Madhavan, the Delhi High Court on Monday restrained several websites and online platforms from making commercial use of his name, image or personality without permission. The court also restrained the accused parties from misusing the actor’s persona by using Artificial Intelligence (AI) and deepfake technology. Also instructions were given to remove some obscene material uploaded on the internet.

A bench of Justice Manmeet Pritam Singh Arora said the court will pass a detailed interim order in the matter. The court gave clear instructions that the ban should be imposed on the grounds of obscenity. The lawyer appearing for the actor told the court that an accused had created a fake film trailer named Kesari 3, claiming that the film was going to be released soon.

In this trailer, content was posted in Madhavan’s capacity using deepfakes and AI generated content. He said that before filing the case, the actor had complained to social media platforms against the infringing content.
