The order of the NIA special court is not being considered as ordinary property confiscation. This is an attack on the thinking in which people sitting abroad kept speaking against India and considered the land of Kashmir as safe capital. For years this ecosystem continued to believe that statements would be made from outside and assets would remain safe within the country. The court’s decision has broken this confusion. This message makes it clear that the price of anti-India will now have to be paid from the roots.

The special court of National Investigation Agency in Jammu and Kashmir ordered to confiscate the property of Kashmiri lobbyist Ghulam Nabi Shah alias Dr. Fai living in America. The court directed to confiscate more than 1.5 kanals of land located in Wadwan and Chattabugh villages of Budgam district. The district administration has been asked to take possession immediately. This decision reflects a strict stance in matters of anti-national activities.

How much land was snatched away and from which areas?

According to the court order, one kanal two marla land in Wadwan village and eleven marla land in Chattabugh village will be attached. The total area is approximately more than 8,100 square feet. The court clarified that before taking possession, correct identification and demarcation of the land will be necessary. For this, help of revenue and police officers will be taken. The entire process will be completed as per the law and in a time bound manner.

What is the legal basis for confiscating property?

The Assistant Public Prosecutor told the court that Dr Fai had already been declared absconding. In the year 2020, a case was registered against him under UAPA. The court had issued him a 30-day notice to appear, but he did not respond. According to law, the property of an absconding accused can be confiscated. This strict order was passed under this provision.

Why were the agencies keeping an eye on Dr. Fai?

Dr. Fai is originally from Budgam district. According to investigating agencies, he has been a supporter of the banned Jamaat-e-Islami. He is considered a close associate of Hizbul Mujahideen chief Syed Salahuddin. He is accused of providing ideological and financial support to terrorist organizations in India. This is the reason why he remained on the radar of security agencies for a long time.

How was ISI connection exposed in America?

Dr. Fai was the main face of the Washington-based Kashmiri American Council. He continued to present it as a human rights platform. But in 2011, an FBI investigation revealed that this organization was working at the behest of Inter-Services Intelligence. US agencies proved that Fai took at least 35 lakh dollars from ISI in two decades. This money was used to influence America’s Kashmir policy.

What is the biggest strategic message of this decision?

This action shows that opposition to India is no longer just rhetoric. Those who target India while sitting abroad, their roots within the country will also not be safe. The property of the absconding accused will no longer become a shield. Investigative agencies have moved forward in the direction of breaking the economic backbone of terrorist and anti-national networks.
