Bombay High Court On Vijay Mallya: Businessman Vijay Mallya, declared a fugitive in the country, got a huge blow from the Bombay High Court on Tuesday. The Bombay High Court has made it clear to Mallya that his petition will not be heard until he returns to the court’s jurisdiction. A bench of Chief Justice Chandrashekhar and Justice Gautam Ankhad has directed Mallya to tell in the affidavit when he will return to India, only after which the court will hear his petition challenging the constitutional validity of the FEO Act, 2018.
recovery over liability
Earlier, senior advocate Amit Desai, appearing for Vijay Mallya, said that where Mallya had a liability of Rs 6,000 crore, about Rs 14,000 crore has been recovered by attaching his properties. We want to close all these cases and clear our liabilities.
On this the judges quipped, ‘How can criminal liability be extinguished without appearing within the jurisdiction of the court?’ ED expressed strong opposition SG Tushar Mehta, appearing for ED, strongly opposed the petition and argued that fugitives should not be allowed to challenge the validity of any act without appearing before the courts of the country.
