Strict instructions from Delhi High Court: DDA ordered to take action on illegal encroachment of Majnu Ka Tila
Delhi High Court has directed to take strict action against illegally running restaurants, cafes and commercial shops in ‘Majnu Ka Tila’ area of Yamuna Khadar area. The court has ordered the Delhi Development Authority (DDA) and concerned authorities to remove encroachments along the banks of Yamuna river, which violate conservation norms and MCD building safety norms, within the ambit of law.
During the hearing, the High Court expressed serious concerns about security. The court, in oral observations, said that almost half of the students of Delhi University (DU) go to this area. The court also raised the question that people have been settled here for the last 50-60 years and illegal activities are going on, yet why has the administration not taken adequate steps till now. The petitioner’s lawyer told the court that due to huge crowd gathering at the end of the year and especially during New Year, there is a possibility of a major accident or stampede.
Officials’ side and STF’s role
During the hearing, the Delhi government’s counsel clarified that the land in question belongs to DDA and the Special Task Force (STF) is already monitoring the case. DDA’s counsel told the court that a ‘suo motu’ complaint regarding the issue has been filed on the STF portal and the drive to remove the encroachment is ongoing.
Main demands of the petition
The petition was filed against buildings in Majnu Ka Tila and New Aruna Nagar that were being used for commercial purposes without approved building plans. The petition also demanded that the National Building Code and fire safety rules be strictly implemented in the area so that any untoward incident can be avoided. Delhi High Court has disposed of this petition by directing the authorities to take appropriate action.
