Bharat Ratna and Padma Awards are not titles, they cannot be placed before or behind the name, doing so is legally wrong: Bombay High Court

Mumbai Bombay High Court said that civil honors like Bharat Ratna, Padma Shri, Padma Bhushan, Padma Vibhushan are not titles. In such a situation, they cannot be placed before or behind anyone’s name.

The court said this on Wednesday when Padma Shri was written in the case title of a petition. Actually, the bench of Justice Somasekhar Sundaresan was hearing the petition. Dr. Sharad Moreshwar Hardikar, awarded Padma Shri in 2004, was also a party in this. His name was written as Padma Shri Dr. Sharad Moreshwar Hardikar in the case title. The judge objected to this. Also said that according to law it is wrong to do so.

Cited the Supreme Court’s 1995 decision

The High Court referred to the decision of the Constitution Bench of the Supreme Court in 1995. In that decision, the Supreme Court had clearly said that Padma Award and Bharat Ratna are not titles and they should not be used in front or behind the name.

Justice Sundaresan said that this decision of the Supreme Court applies to everyone under Article 141 of the Constitution. This should be strictly followed. He directed that all parties and courts should follow this rule in further legal proceedings.

Padma Award is given in 3 categories

Padma awards, the country’s highest civilian honours, are conferred in three categories – Padma Shri, Padma Bhushan and Padma Vibhushan. These awards are given for excellence in diverse fields like arts, social service, science, engineering, business, industry, medicine, literature, education, sports and civil service.
