Supreme Court New Rule: The Supreme Court has taken an important decision. Chief Justice of India (CJI) Suryakant said that in case of legal emergency, citizens can appeal to the Supreme Court even at midnight. According to Chief Justice Suryakant, if a citizen faces a legal crisis, is arrested by investigative agencies or one’s fundamental rights and personal freedom are threatened, then the concerned person can demand a hearing in the Constitutional Court even at midnight. The purpose behind this decision is that time should not be a barrier in getting justice.

CJI Suryakant said that it will be my constant effort that the Supreme Court and High Courts should be people’s courts. In case of legal emergency, there should be a system where citizens can contact the court even after working hours. Meanwhile, the Supreme Court has implemented new Rules of Procedure (SOP) to make the work easier and completed in time. Under this SOP certain time limits have been fixed for advocates.

In all cases advocates will be required to mention the time required for their arguments on the online portal at least one day before the commencement of hearing, senior counsel and other advocates i.e. at least three days prior to the hearing to give a copy of the written statement to the other party. It is stipulated that this written statement should not exceed five pages. These rules will apply.

Overall, it is expected that the judicial process will be faster, disciplined and citizen-centric due to the facility of filing appeals in the court even at midnight during legal emergency and the Nadi SOP implemented for the lawyers. This decision is considered important in order to get justice to the common citizens in time.

The Chief Justice said that petitions on several important constitutional issues are still pending across the country. Their priority is to set up maximum number of constitution benches to dispose of them speedily. These include petitions challenging the validity of the Special Intensive Revision (SIR) process of electoral rolls. It started from Bihar and now it has become a topic of discussion in many states.
