Inhuman crime against innocent girl: Court’s strict decision, death sentence to the accused
Jabalpur/Bhopal : The accused who raped and murdered a 5-year-old innocent girl by stabbing her in her private part has been sentenced to death. Madhya Pradesh High Court has upheld the death sentence for brutally murdering an innocent child. In this case, the mother and sister of the accused, who hid the evidence, have also been sentenced to two years imprisonment.
The High Court considered this as the rarest of the rare case.
The double bench of High Court Justice Vivek Aggarwal and Justice Raj Kumar Choubey found that the accused, after raping the innocent girl, attacked her with a knife in her private part. These things were proved by the postmortem report, after which the double bench considered the incident as the rarest of rare case and upheld the death sentence. This case is from Shahjanabad area of Bhopal, where accused Atul Nihale had filed an appeal in the High Court challenging the death sentence on charges of rape and murder.
Innocent child had gone missing from home
Earlier, the trial court Bhopal had sent the case to the High Court for confirmation of the death sentence. According to the prosecution, “The 5-year-old minor had gone missing after leaving her uncle’s flat in Shahjahanabad area of Bhopal on September 24, 2024.” Before going out, she told her grandmother that she would play and return in 15 minutes. But when she did not return home, her grandmother started searching for her. When she was not found, her family members informed the police.
Dead body was found in a water tank in a neighbor’s house
The police used technical surveillance to find the girl, and also called the dog squad. After this, during the search operation, the police became suspicious about the flat of accused Atul Nihale who lived nearby. There was a bad smell coming from this flat. When the police opened the door, the accused’s mother Basanti Bai and sister Chanchal told the police that the smell was coming due to dead rats and that they had just cleaned the floor with phenyl.
When the police continued searching the place, both the women started shouting for the police to stop, meanwhile the women police sidelined both of them and the search continued. Meanwhile, with the help of dog squad, it was found that the smell was coming from the plastic water tank. As soon as the police team got it opened, everyone was shocked. The dead body of an innocent child was inside the white plastic tank.
Girl brutally raped, had serious wounds in private parts
The court was told during the hearing that the doctors had confirmed that the girl had been brutally raped. His private parts were also badly injured, as if he had been attacked with a sharp object. After this, the police strictly interrogated the accused Atul Nihale and his mother and sister, after which the victim’s clothes and the knife used in the crime were recovered. After the strictness of the police, the accused Nihale confessed to the crime and told the police that his mother and sister had helped in hiding the crime.
Death sentence to the accused, two years imprisonment to mother and sister
While hearing the case, the trial court had punished the accused by hanging under three sections, which was upheld in the main bench of Madhya Pradesh High Court in Jabalpur on Thursday. Apart from this, his mother and sister were punished with two years imprisonment each for hiding evidence. After the hearing, the double bench has justified the decision of the trial court.
