The Supreme Court has granted interim bail to filmmaker Vikram Bhatt and his wife Shwetambari Bhatt in the ₹30 crore fraud case, and ordered them to be released on payment of bail bond. Shwetambari Bhatt is lodged in the Central Jail of Udaipur in a fraud case worth crores. The bench of Chief Justice of India Surya Kant and Justice Joymalya Bagchi gave this order while issuing notice on the petition of Shwetambari Bhatt and Vikram Bhatt, in which they had challenged the order of not granting bail of Rajasthan High Court. Notice has been issued to the Rajasthan government, and the case will be heard next Thursday.
Senior advocate Mukul Rohatgi, appearing for the petitioners, argued that Rajasthan Police came to their Mumbai house and arrested both of them from there. Rohatgi demanded at least interim bail for his wife at the current stage. The lawyer of complainant Ajay Murdia said that this is a case of fraud of Rs 44 crore. The bench asked whether a criminal case was a way to recover the dues.
CJI Surya Kant said, “Unfortunately, they (petitioners) have not sought quashing of the FIR.” CJI Kant said, “How was Rajasthan chosen? Very unfortunately.” Rohatgi said that the complainant wanted films to be made on him. Rohatgi said, “Both the films flopped. It is not my fault. The director and his wife cannot be put in jail.”
The court directed that Shwetambari Bhatt be immediately released on interim bail. When the respondent’s lawyer said that it could not be assumed that a woman would not commit a crime, the CJI asked, “You want us to release both of them on bail?” The court has also made Ajay Murdia, owner of Indira IVF and former Indira Entertainment LLP, Udaipur, a defendant in this case.

Let us tell you that this case started with Murdia’s complaint that Bhatt and his wife instigated him to invest more than Rs 30 crore in his late wife’s biopic, and promised higher returns which were never fulfilled. In December, the Bhatt couple were arrested by the Rajasthan Police from Mumbai.
