Such a question was raised in the court that the petition could not stand, a big hint was given on the environmental clearance.

The Supreme Court of India on Thursday in New Delhi Congress Refused to hear the petition of leader Jairam Ramesh, in which the environmental clearance given to the projects was challenged from the previous date (Environmental Clearance Supreme Court). The bench of Chief Justice Surya Kant and Justice Joymalya Bagchi raised serious questions on the legality of the petition itself.

The bench asked in clear words how a petitioner can review his own earlier decision through a writ petition. The Chief Justice asked Jairam Ramesh’s lawyer to tell the court how this petition is maintainable. It was also commented that the court understands very well the intention behind such petitions.

The court also said that once such a decision (Environmental Clearance Supreme Court) has come, which was canceled by a larger bench during review. Now indirectly an attempt is being made to reconsider the same issue. The bench even said in a strict tone that the petitioner should be prepared to face a heavy fine.

Seeing the strictness of the bench, Jairam Ramesh’s lawyer sought permission to withdraw the petition. While allowing the withdrawal of the petition, the Supreme Court gave freedom to adopt other measures as per law.

It is noteworthy that on November 18 last year, the Supreme Court, overturning its own earlier order, had made it clear (Environmental Clearance Supreme Court) that the Central Government and concerned authorities can give retrospective environmental clearance to projects violating environmental norms on payment of heavy fines. The apex court’s argument was that if this is not done, projects worth thousands of crores of rupees may go waste, causing huge loss of national resources.
